Objeto e aplicação
As presentes condições têm por objetivo definir os termos e condições da prestação de serviços prestados pela Special Surf 78 ao Cliente, bem como, o aluguer de material, desde o ato da reserva à prestação do serviço. Estas condições regulam todas as etapas necessárias para realizar a reserva e garantem o seguimento desta transação entre as partes contratantes. Ao efetuar a sua reserva o Cliente manifesta a sua aceitação plena e completa, das Condições e Termos da prestação de serviços, dos preços, das condições de reserva e de pagamento, do funcionamento das aulas de surf, bem como, do aluguer de material e dos serviços contemplados na respetiva transação.

Condições de Reserva
A reserva fica garantida após o pagamento de 50% do valor total no momento da reserva. O restante pagamento é efetuado até 7 dias antes da chegada. A pessoa que faz a reserva fica responsável pelo pagamento do valor de todas as pessoas incluídas na reserva assegurando que todas elas estão cientes dos termos e condições. O cliente fica obrigado a enviar o comprovativo de transferência do pagamento por email specialsurf78@gmail.com

A reserva só fica concluída com a receção do comprovativo do pagamento.

Condições de Cancelamento
Cancelamentos efetuados até 8 dias antes do dia de chegada, não será aplicada taxa de cancelamento.
Cancelamentos efetuados até 7 dias antes do dia de chegada, não será devolvido o valor já pago.
A partir de 7 dias antes da reserva, não é possível efetuar alterações à reserva e, em caso de cancelamento, não será devolvido o valor já pago.

Cours de surf
Classes are held in the morning and in the afternoon. There may be changes in timetables, in order to ensure the best tides and sea conditions for our classes.

The price includes a 2-hour class, as well as all equipment included (board and suit adjusted to the size and level of the client), personal accident and liability insurance.
The client must show up 20 to 15 minutes before the start of the class.

When the customer books a package of lessons, it will be understood that the customer will have one or two lessons per day (depending on the package of lessons), day after day at the same time, until all lessons in the package are consumed. If the client wants a different schedule or a day without classes, he must inform the team at the Special Surf 78 surf school, 24 hours in advance.

If the client does not show up and does not notify the Special Surf 78 team 24 hours in advance, Special Surf 78 has the right not to carry out a replacement class and not to refund the client.

The class schedule is defined after check-in, after which time the client must go to the Special Surf 78 help desk next to the Star Inn Hotel reception, in order to determine their surf training program with the team from the surf school.

Lessons are not refunded by Special Surf 78 when they cannot be held due to adverse weather and sea conditions, in the absence of waves, in the existence of excessive waves, due to intense fog or strong wind. The Special Surf 78 team will plan one or more alternative activities if one of these very rare cases happens.

The video-correction or photo-correction, when included in the pack or purchased later, will be scheduled at the time of the preparation of the weekly/lesson plan, but it can be anticipated or postponed according to the student's evolution and the teacher's suggestion.

Surfing is a beautiful sport, full of good emotions and much appreciated by all, however it is important to emphasize that it can be very dangerous, the client must strictly follow all the instructions of the teacher, respecting the safety rules and taking precautions against damage to their physical health and that of others.

If the client is injured during the class, he must immediately communicate and quickly inform the teacher so that he can call sports insurance and support service if necessary. If the client does not manifest any complaint at the time he hurts himself in class and later comes to assume that complaint, Special Surf 78 is not bound to activate the sports insurance.

The customer must be responsible for their equipment when transporting it and during the time they use it on the beach and at sea. You must be careful not to damage it and take it clean back to school after class is over.

If the client wants to keep the equipment after class, he will have to pay an extra fee for its rental. (see surf equipment rental conditions).

Equipment Rental (Surf Equipment, Bicycles and Skateboards)

The Special Surf 78 team is made up of experienced surfers from Peniche and surf coaches from the Portuguese Surfing Federation, simultaneously physical education teachers with specialized training in special education and surf teaching for people with special needs. Every day, each professional does their best to ensure that all your wishes and needs are met, ensuring that you have the right material for your level, as well as the ideal place to enter the sea according to your level. The experienced Special Surf 78 team is always available to help.

All equipment is carefully checked by the Special Surf 78 team, ensuring that it is in good condition.

The customer is responsible, financially and personally, for the material rented during the rental period (from the moment you pick it up until the moment you deliver it). 

The Customer is obliged not to leave the equipment on the street overnight. If the rented material is stolen or lost, Special surf 78 must make an assessment of the commercial value and the customer is responsible for paying the total amount calculated.

The customer must present the citizen card, passport or driving license and fill in the equipment rental form (https://specialsurf78.com/rentals/) before paying and renting the equipment.

Payment for the rental of the equipment is made before you start using it.

Rental hours are from 9 am to 8 pm.

The material must be returned in the same condition as it was collected, without damage.

The Customer is subject to penalties for damage to the equipment, partial or total loss, as shown in the table below.

The customer must be responsible for keeping the equipment washed and clean at all times.

Whenever the customer chooses to keep the equipment in their possession for a long period of time, the Special Surf 78 team applies a security deposit of €250 or adopts other measures to ensure the return of the equipment and safeguard the interests of Special Surf 78 and the customer. 

Returning the equipment after the contracted period implies the payment of a fee according to the length of the delay, 30 minutes 1 hour, 2 hours, 5 hours, 1 day, several days. 

The use of equipment rental is the sole responsibility of the customers Special Surf 78's insurance does not cover damage to the equipment and/or stolen and/or total losses, as well as any injuries suffered or inflicted on third parties.

The computerized processing of collected data is carried out in compliance with Portuguese Law 67/98 of 26 October, on the Protection of Personal Data, and they are intended for processing reservations and communicating with Customers, processing requests for information and complaints, statistical analysis, as well as their use for direct marketing purposes.

Special Surf 78, within the scope of the provision of services, carries out videos and photography sessions, which Special Surf 78 may use for any advertising activity, unless consent is withdrawn by the owners of these videos or photographs.

Special Surf 78 will not transmit the personal data provided by the Client to third parties.

The User is guaranteed, under the terms of the law, the right to access and rectify any data concerning him contained in the database, through the following means:

Âmbito
Os presentes TERMOS E CONDIÇÕES aplicam-se à totalidade dos produtos e prestação de serviços disponibilizados ao Cliente.

 

Lei aplicável e competência
Toda e qualquer questão emergente dos presentes TERMOS E CONDIÇÕES, nomeadamente quanto à sua interpretação, validade, eficácia ou execução, é regida e regulada pelo direito Português, sendo este o único aplicável.

Na falta de acordo amigável entre as partes será atribuída competência, para a resolução de qualquer litígio, aos tribunais portugueses competentes.
